1. Acceptance of Terms

By accessing or using Secret Psychic Santa ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Secret Psychic Santa is an AI-powered gift recommendation platform. Users ("Givers") create gift occasions and invite recipients to answer a short self-serve style quiz; our AI turns the recipient's answers into personalized gift recommendations. Separately, any member may opt in to My Registry, connecting their own Etsy account to build a shareable gift registry from their own favorites, purchases, and shop.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 18 years old to use the Service.
• One person may not maintain more than one account.

4. Recipient Consent

By answering the style quiz, recipients explicitly consent to the collection and AI processing of their quiz answers for the purpose of generating gift recommendations. Where a member separately opts in to My Registry, they explicitly consent via Etsy OAuth to our access of their own Etsy account data only. Consent can be withdrawn at any time by requesting data deletion or disconnecting a connected account.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access another user's account without authorization
• Scrape, crawl, or use automated means to access the Service beyond intended API usage
• Use the Service to harass, stalk, or harm any individual
• Circumvent any access controls or rate limits
• Misrepresent your identity or relationship to a recipient

6. AI-Generated Recommendations

Gift recommendations are generated by AI and are suggestions only. We do not guarantee the accuracy, availability, pricing, or suitability of any recommended product. We are not responsible for purchases made based on our recommendations.

7. Payments and Refunds

Payments are processed by Stripe. All fees are non-refundable except as required by law or at our sole discretion. Prices are subject to change with notice.

8. Intellectual Property

The Service, including its design, features, and content, is owned by Secret Psychic Santa. You retain ownership of any data you provide. By using the Service, you grant us a limited license to process your data as described in our Privacy Policy.

9. Third-Party Services

The Service uses third-party product-search providers (including Etsy and Google Shopping) to attach real, purchasable product links to AI-generated gift ideas, and offers an opt-in Etsy connection for My Registry. Your use of any connected third-party platform is governed by its own terms of service. We are not responsible for third-party service availability or changes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECRET PSYCHIC SANTA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
